Online-Tribute.com helps families and friends create a lasting online memorial for someone they love. We know that people often come here at a painful time, and we have tried to keep these Terms as clear and humane as a legal document can be. Please read them: by creating an account, activating a memorial, or contributing to one, you agree to them.

1. Who we are & these Terms

1.1 Online-Tribute.com (the “Site” or “Service”) is operated by Online-RSVP, of 23 Boreland Crescent, Kirkcaldy, KY1 2EZ, United Kingdom (“Online-Tribute”, “we”, “us”, “our”). We also operate the event RSVP and guest-communication platform Online-RSVP.com.

1.2 These Terms of Use (the “Terms”) are a binding agreement between you and us and govern your access to and use of the Site. Some features may have additional published rules; where they do, those rules form part of these Terms.

1.3 Our Privacy Policy explains how we handle personal data and is incorporated into these Terms by reference.

1.4 By logging in, activating a memorial, contributing content, or otherwise using the Site, you confirm that you have read, understood and agree to these Terms. If you do not agree, please do not use the Site.


2. Definitions

2.1 “Memorial” means a single memorial page and its associated content dedicated to one person.

2.2 “Page Owner” means the account holder who creates and is responsible for a Memorial, together with any administrators they appoint.

2.3 “Contributor” means any person who posts content to a Memorial (for example on the Memory Wall, or by uploading photos, videos, RSVPs or donations), whether or not they hold an account.

2.4 “User Content” means any content submitted to the Site by a Page Owner or Contributor, including names, dates, biographical text, obituaries, photographs, videos, audio, messages and family-tree information.

2.5 “you” means any Page Owner, Contributor or visitor using the Site.


3. Eligibility & your account

3.1 You must be at least 18 years old to create or administer a Memorial.

3.2 You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly if you suspect unauthorised use.

3.3 You must provide accurate account information and keep your email address current, as we use it for service and legal notices. A notice sent to the last email address you gave us is treated as received.

3.4 A Page Owner may appoint administrators. The Page Owner remains responsible for everything those administrators do on the Memorial.


4. The service we provide

4.1 Online-Tribute is a self-service tool that lets you build and publish an online Memorial, including features such as designs and themes, an obituary, a life timeline, photo and video galleries, a family tree, a Memory Wall, RSVPs, donations, music, QR codes and TributeAI™. Available features may change over time.

4.2 We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Site to create and manage a Memorial for non-commercial, commemorative purposes. You must not resell, sublicense, copy, reverse engineer, scrape, or use the Site to build a competing product.

4.3 We may change, suspend or discontinue features at our discretion. Where a change materially reduces a paid feature, we will act reasonably and in line with section 13.


5. Who may create a memorial

In short
Create a Memorial for a real, identifiable person you have a genuine connection to (or consent to commemorate). Most honour someone who has died; heartfelt tributes to a living person are welcome too.

5.1 You may create a Memorial to commemorate a specific, identifiable, real person. Most Memorials honour someone who has died; some celebrate the life and achievements of a living person. In every case you must have a genuine personal connection to that person, or appropriate authority or consent to create the Memorial (for example, from the next of kin, the estate, or the living person themselves).

5.2 You confirm that, to the best of your knowledge, you have the right to commemorate the person, to publish the information you provide, and to use any photographs or other materials you upload.

5.3 A Memorial is a place of remembrance and celebration. It must not be created or used for any commercial, advertising, political-campaigning, evidential or adversarial purpose.


6. Your content & the licence you grant

6.1 You retain ownership of your User Content. You are solely responsible for it and for the legal right to publish it.

6.2 You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, to resize images), publish and display your User Content, solely for the purpose of operating, securing, backing up and providing the Service to you and the people you invite. This licence ends when the content is deleted from our live systems, except for residual copies in routine backups and where we must retain content to comply with law.

6.3 Media files you upload are stored and delivered through our dedicated media network at tribute-media.com (including cdn.tribute-media.com). Serving media from this domain is part of how the Service works.

6.4 We are not obliged to store User Content indefinitely and recommend you keep your own copies. You can download Memory Wall contributions and donation records from your dashboard.

6.5 If you send us feedback or suggestions, you agree we may use them freely and without obligation to you.


7. Acceptable Use Policy

7.1 You agree not to upload, post, or transmit any User Content, and not to use the Site, in any way that:

7.2 You must not upload, store or transmit through the Site any official, legal or sensitive document — including identity documents, certificates (birth, death, marriage), contracts, wills, court papers, financial or medical records — whether your own or another person's. The Site is not a document store or records repository.


8. Truthfulness & misuse of memorials

In short
No false or fabricated content, and no memorials weaponised to defame, harass, mislead or pressure anyone — living or dead.

8.1 No false information. You must not publish content you know, or ought reasonably to suspect, to be false, fabricated, or misleading. This includes invented biographical facts, fabricated relationships, or any content designed to deceive readers, including falsely asserting that a person has died.

8.2 No abusive or weaponised use. You must not use a Memorial, the Memory Wall, the obituary, or any other feature to attack, defame, harass, intimidate, shame, expose, or settle scores with any person — whether the person commemorated, their family, or any third party. A Memorial must not be used as a vehicle for grievance, vendetta, or reputational harm.

8.3 No impersonation. You must not impersonate the person commemorated, their family, or any other person, or misrepresent your authority or relationship to the person commemorated.

8.4 We may remove or restrict any content or Memorial that we reasonably believe breaches this section, without prior notice, and without any obligation to assess the truth of competing claims.


9. No legal or official record — no reliance

In short
Everything on a Memorial is submitted by users and unverified. It is not proof of anything and must never be relied on as a legal, official or evidentiary record.

9.1 All User Content — including names, dates of birth and death, places, family relationships, biographical statements, obituaries and photographs — is submitted by users. We do not verify, authenticate, certify or fact-check any of it.

9.2 The Site is a commemorative platform. It is not an official, governmental, legal, genealogical, medical, financial or evidentiary record, and a Memorial does not constitute proof of death, identity, age, kinship, parentage, marriage, inheritance, next-of-kin status, or any other fact or legal relationship.

9.3 You must not rely, and must not encourage or allow any third party to rely, on any content of the Site as evidence or proof of any matter. Any such reliance is entirely at your own risk, and we accept no responsibility for it.

9.4 The presence of a Memorial, or of any name or relationship within it (including in a family tree), does not confer, recognise, or evidence any right, status or entitlement of any kind.


10. Disputes between users & use in proceedings

In short
Don't use the platform to build, support or fight a legal case. We are a neutral host, not a party, witness, or evidence-gathering tool, and we won't take sides in family or legal disputes.

10.1 No use in disputes or proceedings. You must not create, use, edit, preserve or contribute to a Memorial for the purpose of, or in a manner that is intended to, advance, support, influence, manufacture evidence for, or prejudice any actual, threatened or contemplated legal, administrative, regulatory, insurance, immigration, probate, inheritance, custody, family or other proceeding or dispute.

10.2 We are a neutral host. We do not adjudicate, mediate or take sides in disputes between Page Owners, Contributors, family members or third parties — including disputes over who controls a Memorial, what it should contain, or who the deceased's rightful representatives are.

10.3 How we may respond to a dispute. Where we become aware of such a dispute, we may, at our sole discretion and without liability, take any of the following steps: leave the Memorial unchanged; freeze, restrict or hide it; remove specific content; suspend the account; or require the parties to resolve the matter between themselves or to provide a court order or other satisfactory documentary proof before we act. We are under no obligation to take any particular step.

10.4 Legal requests. If we receive a subpoena, court order, regulatory demand or other legal request relating to a Memorial, an account, or User Content, we may comply with it, and where the law allows and we consider it appropriate we will try to notify the affected account holder. Our compliance is not an endorsement of any party's position. You agree that we may recover from you our reasonable administrative and legal costs of responding to any such request that concerns your account or content, except where prohibited by law.

10.5 Not a witness or evidence service. We do not provide testimony, certificates, authentication, attestations, or expert evidence about User Content, account activity, or the operation of the Site, except where compelled by law and subject to section 10.4.


11. Moderation, suspension & removal

11.1 Page Owners control day-to-day moderation of their Memorial and can choose pre-moderation or post-moderation, and can remove any contribution at any time.

11.2 Separately, we may review, refuse, remove, edit, or restrict any User Content, and may suspend or terminate any account or Memorial, where we reasonably believe it breaches these Terms, creates risk or liability, or is the subject of a credible complaint. We may do this with or without notice, at our discretion.

11.3 We have no general obligation to monitor User Content, and the controls above are rights, not duties. We are not liable for User Content created by Page Owners or Contributors.


12. Reporting content & takedown requests

12.1 If you believe content on the Site is unlawful, infringes your rights, is abusive, false, or relates to a living person wrongly presented as deceased, please contact us at contact@online-tribute.com or via our contact page, with: your contact details; a link to the content; a description of the problem; and, for rights complaints, enough information for us to assess and (where relevant) a statement that your complaint is made in good faith and is accurate.

12.2 We will review valid reports and may remove or restrict content, but we are not obliged to remove content merely because it is disputed. We may share the substance of a complaint (but not, where avoidable, your identity) with the relevant Page Owner so the matter can be addressed.

12.3 Knowingly submitting a false or bad-faith report is itself a breach of these Terms.


13. Fees, subscriptions & refunds

13.1 Pricing. A Memorial is activated either by a one-off payment of $95 (the “Lifetime option”) or by a recurring subscription of $8 per month, as displayed at checkout. Prices may change, but a change will not affect a Lifetime Memorial already paid for, and we will give notice before a subscription price changes.

13.2 Payment. Payments are processed by our third-party payment provider (Stripe). You authorise us and our provider to charge your chosen payment method.

13.3 Subscription renewal & cancellation. Monthly subscriptions renew automatically until cancelled. You can cancel anytime from your dashboard; cancellation stops future charges and takes effect at the end of the current paid period. A cancelled Memorial may be taken offline once the paid period ends.

13.4 Lifetime option. The Lifetime option keeps a Memorial online without further activation fees, subject to section 16. You may upgrade from a subscription to the Lifetime option at any time.

13.5 Refunds. Because a Memorial is a digital service made available to you immediately on activation, fees are generally non-refundable once a Memorial is activated, except: (a) where required by applicable consumer law; and (b) we may, at our discretion, offer a goodwill refund of the activation fee if you request it within 30 days of activation. To the extent consumer law gives you a cancellation right for digital content, you acknowledge that activation begins performance immediately at your request.


14. Donations

In short
If you collect donations, you are the recipient and you are responsible for them. We just provide the tool; we are not a charity, trustee or fundraiser.

14.1 The donations feature lets a Page Owner collect payments from Contributors (for example, towards funeral costs). The Page Owner is the sole recipient of, and is solely responsible for, all donations collected through their Memorial.

14.2 We are not the recipient of donations and act only as a technical facilitator. We are not a charity, fundraiser, trustee, escrow agent, or money services business. We make no representation about how donations will be used, and we are not responsible for a Page Owner's use of, accounting for, or tax treatment of, donated funds.

14.3 The Page Owner is responsible for any statements made to donors, for using funds for the stated purpose, for any applicable taxes, registrations or charity-law obligations, and for handling donor refunds and queries.

14.4 Donations are processed by Stripe and are subject to its terms. Payment-processing and service fees apply as disclosed at the time of donation. Chargebacks and payment disputes are handled through the payment provider.

14.5 We may suspend or disable the donations feature on any Memorial where we suspect fraud, misuse, or breach of these Terms.


15. TributeAI™ and automated content

15.1 TributeAI™ can help generate text such as obituary drafts. AI-generated output may be inaccurate, incomplete or unsuitable, and is provided only as a starting point.

15.2 You are responsible for reviewing, editing and verifying any AI-generated content before you publish it, and you remain fully responsible for it as User Content under these Terms.

15.3 You must not input into TributeAI™ any content you are not entitled to use, and you must not rely on AI output as factual, legal, or professional advice.


16. Longevity & availability

16.1 We intend Lifetime Memorials to remain online indefinitely and aim to maintain the Service for the long term. However, this is a good-faith commitment and not an absolute, unconditional guarantee, and it does not apply to content removed for breach of these Terms or where we are required by law to remove it.

16.2 In the unlikely event that we ever cease operating, we have set up a dedicated safety fund intended to cover hosting costs for a minimum of ten (10) years, so that your Memorial page will remain accessible.

16.3 The Service is provided on an “as available” basis. We do not guarantee uninterrupted or error-free operation, and we may carry out maintenance or make changes that cause temporary unavailability.


17. Privacy, security & indexing

17.1 We handle personal data in accordance with our Privacy Policy. Connections are secured, and we apply reasonable technical and organisational measures to protect data, but no online service can be guaranteed perfectly secure.

17.2 By default a Memorial may be discoverable by search engines. A Page Owner can make a Memorial private (for example with a password) and can request that it be excluded from search-engine indexing from the dashboard. Indexing decisions by third-party search engines are outside our control.

17.3 Where you publish information about living people (such as surviving relatives in a family tree or messages), you are responsible for having any consent required by applicable data-protection law.


18. Custom domains & third-party services

18.1 The Site integrates third-party services (for example Stripe for payments, and Google or Facebook sign-in). Your use of those services is subject to their own terms and privacy policies, and we are not responsible for them.

18.2 If you connect your own custom domain, you are responsible for your domain registration and DNS configuration. The Site may contain links to third-party websites that we do not control and do not endorse; you use them at your own risk.


19. Our intellectual property

19.1 Excluding your User Content, all rights in the Site — including its software, designs, templates, layouts, text, graphics, the “Online-Tribute” and “TributeAI™” names, and all related trademarks — are owned by us or our licensors. These Terms grant you no rights in them except the limited licence in section 4.

19.2 You must keep intact all proprietary notices and must not use our names or marks without our prior written consent.


20. Disclaimers

20.1 To the fullest extent permitted by law, the Site is provided “as is” and “as available”, and we disclaim all warranties, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

20.2 We do not warrant that the Site or any User Content is accurate, complete, lawful, reliable, or fit for any purpose, or that the Site will be uninterrupted, secure or error-free. Nothing in these Terms excludes any liability that cannot lawfully be excluded.


21. Limitation of liability

21.1 To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or exemplary loss, or for any loss of data, profits, goodwill, or anticipated savings, arising out of or relating to your use of (or inability to use) the Site or any User Content.

21.2 Subject to section 21.3, our total aggregate liability arising out of or relating to these Terms or the Site will not exceed the greater of (a) the total fees you paid to us for the relevant Memorial in the 12 months before the event giving rise to the claim, or (b) USD 100.

21.3 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded under applicable law.


22. Indemnity

22.1 You agree to indemnify and hold us, and our officers, employees and agents, harmless from any claims, damages, losses, liabilities and reasonable costs (including legal fees) arising out of or related to: (a) your User Content; (b) your use of the Site; (c) your breach of these Terms; (d) your breach of any law or any third party's rights; or (e) any dispute between you and another user or third party, including any attempt to involve us or the Site in such a dispute or in any proceeding.


23. Term & termination

23.1 These Terms apply while you use the Site. We may suspend or terminate your access, account or Memorial at any time if you breach these Terms or where we reasonably consider it necessary to protect the Site, other users, or third parties.

23.2 On termination, your right to use the Site ends and your User Content may be deleted from our live systems. Sections that by their nature should survive termination — including sections 6, 9, 10, 19, 20, 21, 22, 25 and 26 — will continue to apply.


24. Changes to these Terms

24.1 We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Site and, where appropriate, notify account holders by email. Changes take effect when posted (or on any later date we state), and your continued use of the Site after that means you accept them.


25. Governing law & jurisdiction

25.1 These Terms, and any dispute arising out of or in connection with them or the Site, are governed by the laws of Scotland, United Kingdom, without regard to conflict-of-law rules.

25.2 The courts of Scotland will have non-exclusive jurisdiction over any such dispute, except that nothing prevents either party from seeking urgent injunctive or equitable relief in any competent court, and except that mandatory consumer-protection rights in your country of residence are not affected.


26. General

26.1 Entire agreement. These Terms (with the Privacy Policy and any feature-specific rules) are the entire agreement between you and us regarding the Site.

26.2 Severability. If any provision is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions stay in force.

26.3 No waiver. A failure to enforce any provision is not a waiver of it.

26.4 Assignment. You may not assign these Terms without our consent. We may assign them, for example as part of a business transfer.

26.5 No partnership. Nothing in these Terms creates any partnership, agency or employment relationship between you and us.

26.6 Electronic communications. You consent to receive communications from us electronically, and agree that electronic notices satisfy any legal requirement that they be in writing.

26.7 Headings. Headings are for convenience only; “including” means “including without limitation”.


27. Related services

27.1 Online-Tribute is operated by Online-RSVP, who also provide Online-RSVP.com, our event RSVP and guest-communication platform.

27.2 Media uploaded to the Site is hosted and delivered through our media network at tribute-media.com. These related services are operated by us and may have their own terms where they apply.
